
If one lives in Minnesota, now is a good time to get updated on some of the regulatory activities taking place there that affect vaping products. In Minnesota, attorney general Keith Ellison is working hard to ensure new classes of vapes don’t skirt the stringent laws the state has instituted to shield under 21 youth. This specifically states that vaping products can’t resemble candy, school supplies, depictions of entertainment personalities, or other deceptive shapes or forms that can lure young people to use them.
Minnesota Attorney General Takes on Illegal Vape Advertising and Retailing
On January 14, 2025, the attorney general filed a lawsuit against High Light Vape company, due to their deceptive manufacturing, packaging, and advertising practices. The company refers to its vape products as good for ‘discrete’ or ‘stealthy vaping’. That action followed his 2024 warning letters to over 5,000 businesses. In the letters, Mr. Ellison mentioned that Minnesota law will not allow retailers to sell vapes that imitate colorful, familiar objects or characters, which is done purposefully to attract minors to vaping. He posted on his X account how some of the new vaping products look very much like highlighter pens used for schoolwork. He held a highlighter pen and a very similar looking vape product side by side, and the appearance was deceptively the same. The idea is that this resemblance could perhaps cause kids to think the vape was okay, as it looks like something that’s harmless, that they are familiar with.
More About Minnesota’s Updated Vape Laws
In October 2024, Minnesota enacted 325F.7821 PROHIBITION ON DECEPTIVE VAPOR PRODUCTS. Mr. Ellison has said the Minnesota law isn’t for punishing business owners operating in good faith. The state just wants to keep under 21 youth from being targeted with vape products. He encouraged the public to report violations to his office for potential enforcement action. Minnesota wants to make this push for enforcement a priority for public health.
Minnesota’s Clean Indoor Air Act has been amended, too. Wherever smoking is prohibited indoors, so is vaping, including in public transportation vehicles, plus in both work vehicles and home offices with more than one person present. Outdoor vaping isn’t regulated, regardless of distance from entryways.
Municipalities are Allowed to Add Their Own Restrictions
On top of what Minnesota prohibits, various municipalities in the state have imposed their own restrictions. Primarily, this is to protect under 21 youth from using vape products.
